How overtime pay works

Under the federal Fair Labor Standards Act, most non-exempt employees must receive at least 1.5 times their regular rate for hours worked over 40 in a workweek. For example, at $20 an hour, the overtime rate is $30 an hour. A worker who puts in 50 hours earns $800 for the first 40 hours and $300 for 10 overtime hours, a total of $1,100.

Overtime pay formula

Overtime rate equals regular rate times the overtime multiplier. Overtime pay equals overtime hours times the overtime rate. Total pay equals regular pay plus overtime pay.

State overtime rules can differ

Some states add rules on top of federal law. California requires overtime for hours over 8 in a workday and double time after 12 hours in a day. Alaska also requires daily overtime over 8 hours. Colorado requires overtime after 12 hours in a day or 12 consecutive hours. Nevada applies daily overtime for some lower-paid workers. Rules and exceptions change, so confirm with your state labor agency.

Who does not get overtime?

Exempt employees, such as some salaried executives, administrative and professional workers, do not receive overtime under federal law. Exemptions depend on job duties and salary level, not only on the job title. This calculator also does not include bonuses that may change your regular rate.
